Dissolution of Marriage
California is a no-fault divorce state. This means the California Family Code allows only two grounds for the dissolution of a marriage or a legal separation of a married couple are (1) irreconcilable differences that have caused the irremediable breakdown of the marriage or (2)incurable insanity on the part of one of the parties.
According to the Family Code at least one of the parties in a dissolution action must have been a resident of California for at least six months, and of the county in which the petition was filed for three months, immediately before the filing of the petition. This residency requirement cannot be waived. There is no statutory residency requirement of a legal separation judgment.
Nullity
The Family Code allows for a judgment of nullity (formerly an annulment) only when a marriage is either void or voidable by statute. A marriage is void in cases of incest and bigamy , and is voidable in the cases of minority, unsound mind, fraud, force, physical incapacity and where a current spouse is mistakenly believed to be deceased.
Registered Domestic Partners
Since January 1, 2005, California’s divorce laws apply equally to registered domestic partners who seek to dissolve their registered partnership.
